вот с понда Дана прислал мне договор по альтернативной лицензии.... мол пондовская покупателю не подходит... готовы 750 заплатить, мне соответственно 375.
там был факс, поэтому тут как распознавалка текста поняла выкладываю.

This release (the “Release") is made and entered into as 0fN0vember 22, 2010 by and between Ludus Product (“Pr0dueer") and the undersigned with respeet to that certain motion picture presently entitled (the “Pieture”).

For good and valuable consideration, the receipt and sufliciency of which is hereby acknowledged, the undersigned hereby irrevocably grants to Producer, its assignces and licensees, the irrevocable right (without obligation), in Producer’s sole discretion, to use, photograph, film, videotape, record, and/or otherwise fix or reproduce (collectively, the “Results”) that (those) certain photograph(s) and/or artwork listed in the attached Exhibit “A” (which is attached hereto and incorporated by reference) and, without limitation, any artwork, names, characters, likeness, products, trademarks, service-marks, trade-names, logos, copyrighted material and/or other materials and intellectual property rights related to the photograph/artwork (collectively the “Photograph/Artwork”) in connection with the Picture and the production, distribution, exploitation, marketing, sale, exhibition, advertising or promotion ofthe Picture and any and all derivative works, allied, ancillary and/or subsidiary rights thereof, throughout the universe in perpetuity, in any and all media, means, methods or processes, now known or hereafter devised.

The undersigned hereby represents and warrants that the undersigned has the right to enter into this Release and to grant to Producer the rights granted herein and no other rights, clearances or permissions shall be necessary (including, without limitation, from any actors, models, and photographers) and no other payments shall be necessary in connection with Producer's use of the Photograph/Artwork. The undersigned shall indemnify and hold Producer harmless from and against any and all loss, cost, liability, damages or claims (including attorneys’ fees) of any nature arising from any breach of any warranty made by the undersigned in this Agreement. In the event 01’ any breach ofthis Release by Producer, the undersigned hereby acknowledges that the undersigned shall be limited to the undersigned’s right to receive monetary damages only (ifany) and the undersigned hereby waives the undersigned’s right to seek or obtain injunctive or other equitable relief. Producer shall have the right to assign this Release, in wholc or part, to any third party.

The undersigned hereby acknowledges that as between the undersigned and Producer, Producer shall own all right, title and interest, under copyright and otherwise, in and to the Results and the Picture throughout the universe in perpetuity for all purposes and uses in Producer’s sole and absolute discretion.

This document contains the full and complete understanding between the parties and cannot be modified except by an agreement in writing signed by each party hereto. This Release may be executed via facsimile and such
facsimile copy shall constitute an original copy ofthis Release;
IN WITNESS WHEREOF, this Release is executed as ofthe day first written above.

серьезный документ ) а что Вас смущает?
если в продаваемом видео нет ничего такого, к чему могут быть претензии третьей стороны, то почему бы и нет.

+ я бы разделил: часть за видео через понд с 50% комиссией, а за подписывание бумажки отдельно, не делясь с пондом (если у вас прямой контакт)

я не знаю понд это или клиент предложил, письмо от понда приходило.... может мне следовало поднять стоимость этого ролика тут же до 750.... но думаю они сами там должны разобраться
